Update: Student Refuses to Wear RFID Chip ID and other Education GIS News

On Jan 8, 2013 a judge ruled on the Texas case where a student protested wearing an RFID-enable school ID on religious grounds:

A Texas school district can transfer a student who is citing religious reasons for her refusal to wear an identification card that is part of an electronic tracking system, a federal judge ruled on Tuesday.

Basically,  U.S. District Judge Orlando Garcia stated that Andrea Hernandez can agree to the accomodation by the magnet school (wearing a badge but one without an RFID chip) or be transfered to a school that does not use such badges (her local school).

But the case may go on:

John Whitehead, president of The Rutherford Institute, a Virginia-based civil rights group that is representing Hernandez and her family in court, said his organization plans to appeal the judge's ruling.

Whitehead said he expects Hernandez and her family will not accept the school district's compromise of wearing a badge without the tracking chip.

The Northside Independent School District in San Antonio high school student was suspended for refusing to wear an RFID chipped ID card.

The gird refuses to wear the badge on privacy and religious gorunds. The school district insists that as of Mondy she no longer attend John Jay High School and must instead attend another district school that does not yet require the tags. The district offered to let her use the ID without a battery and chip, but her father said that deal comes with a promise to stop criticizing the program and instead support it. The father was not comfortable with that.

The Rutherford Institute will take on the district (statement). RI suggests the technology is about making the school money:

Like most state-financed schools, the district’s budget is tied to average daily attendance. If a student is not in his seat during morning roll call, the district doesn’t receive daily funding for that pupil because the school has no way of knowing for sure if the student is there.

But with the RFID tracking, students not at their desk but tracked on campus are counted as being in school that day, and the district receives its daily allotment for that student.

What is the Rutherford Institute:

The Rutherford Institute is a civil liberties organization that provides free legal services to people whose constitutional and human rights have been threatened or violated.

On December 7 the Nebraska Dept of Education is expected to approve updated social studies standards. (For background read this article on the submission of the draft back in Oct.)

Among the additions:

>> Climate change makes its debut as a concept for discussion in high school geography classes.

The final version, however has significant cuts to the standards for geography including the removal of discussions of geographic response to natural disasters, economic interdepenance, local, country and worldwide demographics. Some critics want to see climate change removed and American exceptialism added.
